  1. Definitions

  • The terms used in the Regulations shall mean:

    Working days - these are days from Monday to Friday excluding public holidays;

    The client - natural person hasca pea natural person with a limited capacity to perform acts in law, and in cases provided for by generally applicable regulations, a natural person with a limited capacity to perform acts in law; a legal person or an organisational unit without legal personality, whichóto whom the law confers legal capacity; - whoóra under the terms of these Regulations shall place its orderóRALLY.

    Civil Code - the Act of 23 April 1964;

    Consumer - a natural person of age possessca pewith full legal capacity, making a purchase from the Seller not directly connected with his/her business or professional activity.

    Newsletter - a service consisting in the possibility of receiving commercial information from the Seller in the form of messages sent to the e-mail address provided by the Client. For this purpose, the correct e-mail address must be provided or an appropriate field must be activated in the registration form or in the ZamóNEWS

    Regulations - this document;

    Goods - a product presented in the Internet Shop, whichóhe description is available for each of the products presentedów;

    Sales Contract - the contract of sale of the Goodsówithin the meaning of the Civil Code, concluded between the Seller and the customer;

    Services - services provided by the Seller to the Customeróby electronic means within the meaning ofóin the Act of 18 July 2002 on provision of services by electronic means;

    Customer - a natural person who hasca pea natural person with a limited capacity to perform acts in law, and in cases provided for by generally applicable regulations, a natural person with a limited capacity to perform acts in law; a legal person; or an organisational unit without legal personality whichóto whom the law confers legal capacity; - whoówho uses or intends to use an Electronic Service.

    Consumer Rights Act - Act of 30 May 2014 on consumer rights ;

    ZamóOrder - a declaration of will of the Customer, aiming directly at the conclusion of a Sales Agreement, specifying in particularóIn the event of any change in the type and quantity of the Goods.

2 Provisions ogólne

    • These Rules of Procedure set out the followingóeral conditions, modalitiesób to provide electronic services and sales via the Internet Shop kociewskiecentrumkolagenu.pl

      These Terms and Conditions are available on the website at all times kociewskiecentrumkolagenu.pl in the manner ofób to enable it to be retrieved, reproduced and preserved by means of printing or recording on a medium at any time.

      A prerequisite for using the Store is reading these Terms and Conditions and its full acceptance. It is understood that reading and acceptance of these Terms and Conditions is tantamount to the provision of information by the Entrepreneur to the consumer (Customer), whichóThe information referred to in Article 12 of the Consumer Rights Act of 30 May 2014 is contained in the following paragraphs of the Terms and Conditions.

      The use of the Internet Shop is possible on condition that the data communication system, with whichóThe following minimum technical requirements apply: computer or mobile device with Internet access, access to e-mail, Firefox, Internet Explorer, Chrome, Opera, Safari web browser, enabling Cookies and Javascript in the web browser.

      The Customer is obliged to:

      • to be specified when registering and orderingóthe information provided in the Internet Shop is only accurate, up-to-date and contains all the necessary information, as well asóand to update them without delay.

        use the services made available by the Seller in the mannerób not disturbing the functioning of the Seller, the Internet Shop or other Clientsów ;

        use the services made available by the Seller in the mannerób in accordance with the law and the provisions of these Rules.

    • From 1 January 2021, the consumer-related provisions set out in these terms and conditions and in the Consumer Rights Act (right of withdrawal, warranty liability, prohibited contractual provisions) shall apply to contractsin the agreements concluded since that dateóalso to the clientów who are natural persons concluding a contract directly connected with their business activity, where the content of those contractsóit follows that they do not have a professional character. In order to determine whether such a customer has consumer rights under certain circumstances, it should be verified whether the concluded contract is of a professional nature on the basis of the trader's entry in the Central Business Register and Information on Business Activity of the Republic of Poland.

3 Services

    • Services are provided by the Seller free of charge, 24 hours a day, 7 days a week.

      The Service Provider provides the following Electronic Services to the Customer via the Internet Shopów:

      • Skorderingónion and conclusion of Agreementsóon Sale, on the terms and conditions set out in these Terms and Conditions

        Agreement for the provision of an Electronic Service consisting of enabling the placement of an OrderóThe contract between the Orderer and the Store is concluded for a definite period and terminates as soon as the Orderer submits theóThe Service Recipient shall be entitled to terminate or cease submitting the request.

        Newsletter;

        The Newsletter is a service provided at the request of the Customer upon conclusion of the Contract, which includes the receipt by the Customer ofóin whichówho will make availablehave been uslenders swój e-mail address, by electronic means, of commercial information on productsóthe Service Provider's products and services, including in particularóLiabilityYou will be informed about their current offers, promotions, discounts and marketing campaigns.

    • The Newsletter service provision agreement shall be concluded for an indefinite period of time and shall terminate upon the Customer's sending a request to remove his/her email address from the Newsletter subscription service or unsubscribe from the Newsletter service with the use of a link in the message sent as part of the Newsletter service.

      The Service Provider may terminate the Service Agreement with the Client at any time with 14 days' notice for important reasons, understood as a change in the provision ofóin the laws governing the provision of services by electronic means by the Service Provider affecting the mutual rights and obligations set out in the agreement concluded between the Client and the Service Provider or a change in the scope or provision of services to whichówhich the provisions of the Rules of Procedure shall apply.

      In the case of violation by the Client of the provisions of these Regulations, the Service Provider, after an ineffective call to cease or remove the violations, setting an appropriate period of time, may terminate the contract for the provision of Services with 14 days' notice.

      Termination of the Account Service Agreement by któeither of the Parties, as well asóThe termination of the agreement for the provision of the Account service with the consent of both parties shall also not affect the rights acquired by the parties prior to its termination.

4 The contract of sale of goodsów

    • Information about the Goods provided on the Shop's websites, in particularóIn accordance with Article 71 of the Civil Code, their descriptions, technical and application parameters and prices constitute an invitation to conclude an Agreement.

      All Goods available at the Online Store are brand new and free from physical and legal defects. They are dietary supplements as defined in Article 3 (39) of the Act of 25 August 2006 on food and nutrition safety.

      The seller has complied with the obligation set out in the EU regulation (Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers).

      The condition for submission of the OrderóTo place an order, you must have an active e-mail account. In the Order FormóThe following data is required: name, surname, delivery address, e-mail address, contact phone number. Failure to fill in the form correctly or providing incorrect data may result in the Online Shop withdrawing from the fulfilment of the order.óThe Customer will be informed of the results of the investigation. Failure to exercise due diligence when completing the form may result in the Customer incurring additional costsóof which: costóin the nature of indemnity, the cost ofóin an erroneous dispatch, the costóin re-dispatch, and other reasonable costsóin whichóthat were incurred by the shop in fulfilling the orderórally.

      In the case of submission of Ordersónformation via the order formóThe Order is available on the website of the Online Shop, Orderóis submitted to the Seller by the Client in an electronic form and constitutes an offer to conclude a Sales Contract for Goodsóin the subject of the contractóThe offer is binding for the Customer. An offer submitted in electronic form is binding upon the Customer if the Seller sends a confirmation of acceptance for execution to the e-mail address provided by the Customer.óriences, whichóre constitutes a statement of the Seller on the acceptance of the Customer's offer and upon its receipt by the Customer the Sales Agreement is concluded.

      The sales contract is concluded in the Polish language.

      Zamóome of the possibilitieson składa24 hours a day. ZLADINGóThe Commission shall be notified of the date on which the contract is terminated and of the date on which it is deemed to entail an obligation to pay.

5. delivery of goodsów

    • Delivery Goodsóis delivered to the address indicated by the Customer when placing the orderóAGENTS. Delivery of goodsóis limited to the territory of the EU countries.

      Delivery Goodsóis carried out by a courier company.

      The Buyer may collect the goods in person at parcel collection points (InPost parcel machines).

      The Seller on the websites of the Store in the description of the Goods informs the Client about the number of working Days needed to complete the OrderóThe Seller shall be obliged to bear the costs of delivery and of delivery of the Goods, as well as the charges for delivery of the Goods.

      Delivery and completion date ZamóThe duration of the termination period is counted in Working Days.

      If for Goodsóin those covered by ZamóThe implementation period is different for the whole of the OrderóThe longest period of theód. foreseen

      Delivery time is 2-3 days if the goods are in stock. Otherwise it may take up to 4-5 days.

6 Prices/Payments

    • Prices of goodsóThe prices are quoted in Polish zloty, Euro at the Customer's choice, and include all components, including VAT and other charges.

      Customer canyou can choose the following methods of paymentthese :

      • Payment online and p-cardsby payment (via Przelewy24) - - in this case ZamóThe order will commence once the Seller has sent the Customer a confirmation that the order has been accepted.óThe Seller will make the shipment as soon as the Order is complete and the Seller receives information from the payment agent system that the Customer has made the payment.óThe user will be informed of the amount to be paid.) - When making a payment, the user shall be informed immediately prior to the payment about the amount to be paid, the possible ways of making the payment and the details of the payment operator, if a given service offers such a possibility. Detailed regulations for making payments via the operatoróThe website of the electronic payment operator is available on the website of the given operator. - When making a payment via an electronic payment operator, the User shall follow the instructions provided by the electronic payment operator in order to make the payment.

        On delivery, i.e. by card or cashóby cash on delivery to the buyer - available only in Poland - (in this case the processing of the orderóThe order will be sent to the Customer by the Seller and its dispatch will commence after the Seller has sent the Customer a confirmation of acceptance of the orderónformation and completion of the Zamórally);

        The Customer authorises the Seller to issue a VAT invoice without the recipient's signature in electronic form (or any other bill documenting the sale in electronic form).

7 Right of withdrawal

    • The consumer whoóry concluded a remote agreement, may withdraw from the Agreement for the sale of goods without specifying a reason by submitting an appropriate statement within 14 days from the date of delivery of the goods.

      The consumer whoówho has concluded a distance contract may withdraw from a service contract or a contract for the supply of digital content whichóThe customer may terminate the contract without giving reasons by submitting a declaration to this effect within 14 days from the conclusion of the contract.

      The period for withdrawal shall begin:

      • for a sales contract - from the time when the consumer or a third party indicated by the consumer other than the carrier takes possession of the goods, and in the case of a contract whichóra includes many commoditiesóin whichóare delivered singly, in instalments or in parts, from taking possession of the last good, instalment or partthese,

        for other umów - from the date of conclusion of the contract.

    • Customer canże formulationThe customer may withdraw from the Agreement by himself or by using a specimen declaration of withdrawal from the Agreement (appendix no. 1).

      Upon receipt of the declaration of withdrawal from the Agreement by the Consumer, the Seller shall send to the Consumer's e-mail address a confirmation of receipt of the declaration of withdrawal from the Agreement.

      In the case of withdrawal from the Remote Agreement, the Agreement shall be considered as not concluded. What the parties have provided shall be returned in an unchanged condition, unless the change was necessary in order to determine the nature, characteristics and functionality of the Goods. The return shall take place immediately, no later than within 14 days.

      The purchased Goods shall be returnedóto the Seller's address.

      The Seller shall promptly, but not later than within 14 days from the date of receipt of the Consumer's declaration of withdrawal from the Agreement return to the Consumer the amount of the Consumer's remuneration.óThe Seller shall reimburse to the Consumer all payments made by him, including the costs of delivery of the Goods. The Seller shall reimburse the payment using the same means of payment as the Consumer used, unless the Consumer agrees to another wayób return, whereby the manneróThis will not entail any costs for the consumer.

      The Seller may withhold the reimbursement of payments received from the Customer until it has received the item back or the Customer has supplied evidence of having sent it back, whicheveróThe event will take place earlier, unless the Seller has offered to collect the item from the Customer himself.

      If the Consumer has chosen wayb delivery of the Goods other than by the least expensive usual meansób delivery offered by the Seller, the Seller shall not be obliged to reimburse to the Consumer the additional costs incurred by the latterów.

      The Customer shall only bear the direct cost of returning the Goods, unless the Seller has agreed to bear that cost.

      From 1 January 2021, the consumer provisions set out in this Chapter shall apply to contractsin the agreements concluded since that dateóalso to clientsw who are natural persons concluding a contract directly connected with their business activity, where the content of those contractsóit follows that they do not have a professional character. In order to determine whether such a customer has consumer rights under certain circumstances, it should be verified whether the concluded contract is of a professional nature on the basis of the trader's entry in the Central Business Register and Information on Business Activity of the Republic of Poland.

8 Exclusion of the right of withdrawal

    • The Consumer's right of withdrawal is excluded in the case of:

      • servicesug, jeif the Seller has performed a service in full with the express agreement of the Consumer whoóry has been informed before the performance starts that after the Seller's performance he will lose the right to withdraw from the Contract;

        Contracts in whichówhere the price or remuneration depends on fluctuations in the financial market over whichówhich the Seller does not control, and whichówhich may occur before the expiry of the withdrawal period;

        Contracts in whichóWhere the object of the supply is a non-refabricated good produced to the Consumer's specification or intended to meet the Consumer's individual needs;

        Contracts in whichóIf the subject matter of the performance is a perishable good or a good with a short shelf life, the performance shall be limited to a period of three months.óThe product has a long shelf life;

        Contracts in whichóWhere the object of the supply is Goods supplied in sealed packaging whichówhich, once opened, cannot be returnedófor reasons of health protection or for reasons ofóin hygienic conditions if the packaging was opened after delivery;

        Contracts in whichóWhere the object of the supply is the Products whichóre after delivery, due to theirój nature, are inseparable from other things;

        Contracts in whichóthe object of the supply is alcoholic beverages whichóthe price of which has been agreed upon at the conclusion of the Sales Agreement and whichówhich can only be delivered after 30 days and whichóThe value of which depends on market fluctuations, over whichówhich the Seller has no control over;

        Contracts in whichówhere the consumer has explicitly requested that the Seller come to him to carry out an urgent repair or maintenance; if the Seller provides in addition other services than those whichonformance of which the consumer requested, or supplies Goods other than replacement parts necessarily used in performing repair or maintenance, the right of withdrawal shall apply to the additional services or Goodsów;

        Contracts in whichówhere the subject matter of the supply is a sound or visual recording or a computer program supplied in sealed packaging if the packaging was opened after delivery; the supply of a journalóin, periodicalóor periodicals, with the exception of the Subscription Agreement;

        Contract concluded by public auction;

        Contracts for the provision of accommodation other than for the purpose ofin dwellings, carriage of goods, hire of carsów, catering, servicesug(b) the provision of services in connection with holidays, entertainment, sporting or cultural events, if the contract specifies the date or period for the provision of the servicesservices;

        Contracts for the supply of digital content whichówhich are not recorded on a tangible medium, if performance has begunabout siThe Seller shall be entitled to withdraw from the Contract with the express consent of the Consumer before the end of the period for withdrawal and after having been informed by the Seller of the loss of the right of withdrawal.

9 Complaint procedure

    • The Seller has a sufficiently formalised complaints procedure and recognises complaints in accordance with this procedure.

      The customer is entitled to lodge a complaint againstóregarding the performance of the sales contract as well as the performance of the contract for the provision of electronic services.

      For the purpose of performance of the sales contract, the Seller shall be obliged to deliver Goods without defects. The Seller shall be liable to the Customer under the warranty for defects under the terms of art. 556 - 576 of the Civil Code.

      It is usually advisable to deliver the purchased goods to the sellerótogether with the complaint, in order to enable the Seller to examine the goods.

      It is recommended toThe Customer should provide the following in the description of the complaint (1) information and circumstances regarding the subject matter of the complaint, in particularó(2) request for a method of bringing the goods into conformity with the Sales Agreement or a declaration on price reduction or withdrawal from the Sales Agreement;

      The Seller undertakes to examine each complaint within 14 days. In case of noóIn the case of a complaint, the Seller shall call the Customer to supplement it to the extent necessary, immediately, but no later than within 7 days from the date of receipt of the call by the Customer.

      HedgehogIf the customer bthe consumer has requested replacement or removal of the defect or has made a declaration concerning a reduction in the price, specifying the amount by whichóIf the price is to be reduced and the Seller does not respond to this request within 14 calendar days, it shall be deemed that the request is justified.

      On the performance of the contract for the provision of electronic services Customer canthat the Seller may submit complaints regarding the functioning of the Store and use of the Services. Complaints may be submitted in writing to the address indicated in paragraph 4.

10. Out-of-court complaint and redress procedures

    • The seller informs about the possibility to use out-of-court meansóin handling complaints and redress. Such use is voluntary and can only take place if both parties to the dispute agree to it.

      The customer, bAs a consumer, you have the right, for example, to returnóprove themselves to the staThe Seller may request the Court of Arbitration for Consumers operating at the Trade Inspection to resolve a dispute arising from the concluded Sales Agreement;

      On the basis of the Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013, we inform you that at http://ec.europa.eu/consumers/odr/. an online dispute resolution platform is availableóbetween consumers and traders at Union level (the ODR platform). The ODR platform constitutes a website with a one-stop-shop for consumersóin and entrepreneuróseeking to resolve out-of-court a dispute concerning contractual obligations arising from an Internet sales or service contract.

11. Provisions concerning the Entrepreneuróin (B2B)

    • From 1 January 2021, this Chapter shall not apply to the customerów who are natural persons concluding a contract directly connected with their business activity, where the content of those contractsóit follows that they are not of a professional nature. In order to determine whether such a customer has, in certain circumstances, consumer rights (e.g. the right to withdraw from a contract, liability under a warranty, prohibited contractual provisions), it should be verified whether the concluded contract is of a professional nature on the basis of an entry of that entrepreneur in the Central Register of Business Activity of the Republic of Poland.

      In accordance with Article 558 § 1 of the Civil Code, the Seller's liability under warranty towards the Customer, who is an entrepreneur, is excluded.

      The Seller has the right to withdraw from the Sales Agreement concluded with the Entrepreneur within 14 days from the date of its conclusion. In this case the withdrawal from the Sales Agreement may take place without giving any reason and does not give rise to any claims by the Customer against the Seller.

      In the case of the CustomeróIf the Customer is an Entrepreneur, the Seller has the right to limit the available payment methods, including the requirement to make a full or partial prepayment, regardless of the payment method selected by the Customer and the fact of concluding a Sales Agreement.

      When the goods are handed over by the seller to the carrier, the per customer bhe Entrepreneur's benefitthose and thoseIn such a case, the Seller shall not be liable for loss or damage of the goods from their receipt to their delivery and for any delay in delivery. In such a case, the Seller shall not be liable for loss, damage or impairment of the goods from their receipt to their delivery to the Customer and for any delay in delivery.

      Settlement of potential disputesóarising between the Seller and the Customer, whichóry is an Entrepreneur shall be submitted to the court having jurisdiction over the registered office of the Seller.

12. Clause fploughing majeure (Sihigher)

    • Neither party shall be liable for failure to perform anyóany of its obligations if such failure is caused by an unforeseeable event beyond its control or by a force majeure incident, including but not limited to epidemic, flood, fire, storm, shortage of raw materialsóIn the event of an occurrence of any of the above events, the affected Party shall immediately notify the other Party not later than 5 working days after the occurrence of the event. The Party affected by such events shall immediately notify the other Party no later than 5 working days after the occurrence of the said event.

      The Parties agree that the co-operationóThey will strive to meet the commitment as best they can while such events continue.

      This clause shall in no way limitób consumer rights.

13. protection of personal data

    • Provided by the customeróThe Seller collects and processes personal data in accordance with applicable laws and in compliance with the Privacy Policy.

      The Seller shall apply appropriate technical and organisational measures to ensure the protection of the personal data processed.

      Additional explanations regarding the protection of personal data are contained in the "Privacy Policy" available on the Website.

14 Final provisions

    • All rights to the Internet Shop, including proprietary copyrights, intellectual property rights to its name, Internet domain, the Internet Shop website, as well as to the forms, logosóThe use of the goods shall be restricted to the Seller and may only be exercised in the following waysób specified and in accordance with the Regulations.

      The law applicable to the contractóThe law of Poland is the law of the country. National Conventionóin the United States on contracts for the international sale of goodsów, done at Vienna on 11 April 1980, shall not apply.

      Wybór of Polish law as applicable does not deprive the clientówho are consumers, the protection afforded to them by the law of their habitual residence in the EU.

      In matters not covered by these regulations, Polish regulations shall apply.

      Each Customer shall be informed of any amendments to these Terms and Conditions by information on the home page of the Internet Shop containing a summary of the amendments and the date on which they become effective.
